Terms and Conditions for Programmatic DOOH Awards
1. Introduction and acceptance. These Terms and Conditions govern all entries to the Programmatic DOOH Awards, which are to be submitted through the Entry Portal (the "Portal") operated by JCDecaux UK Limited ("JCDecaux", "we", "us", or "our"). By creating an account, submitting an entry, or otherwise using the Portal, you agree to be bound by these Terms and Conditions. If you are submitting on behalf of a company, client or team, you represent and warrant that you have authority to accept these Terms and Conditions on their behalf.
2. Entry Conditions:
- Entries must relate to work that has been commercially carried out for a bona fide client and has been run as an out-of-home (OOH) campaign. We reserve the right to require evidence substantiating commercial release and Programmatic OOH delivery. Entries that cannot be verified to our reasonable satisfaction or which do not otherwise meet these Terms and Conditions may be rejected or disqualified at our discretion and without any liability.
- By entering, you grant us a non-exclusive, worldwide, royalty-free licence to publish, reproduce, distribute, and communicate to the public the full executive summary overview uploaded to the Portal together with any images or videos you provide for publication, in connection with the awards and related publicity, including online, in press releases, social media channels, and post-event materials. If any portion of your entry is confidential or not for publication, you must clearly and conspicuously mark such elements "Not for Publication" at the time of submission. We will take reasonable steps not to publish materials so marked, but we are not responsible for any publication of material not correctly or clearly marked as confidential.
- All entries submitted must comply with applicable law and not infringe any third party rights.
- You represent and warrant that you have obtained all necessary permissions, consents, and approvals from the client and any other agency or stakeholder, including rights holders for all creative materials, prior to submission.
- You further represent and warrant that your entry materials do not infringe any third-party rights (including intellectual property, privacy, and publicity rights), are not defamatory, and comply with applicable laws and advertising standards. You agree to indemnify us and hold us harmless from any loss, damage, liability, cost, or expense arising from any breach of this clause or any claim by a third party relating to your entry.
3. Judgement
- Once entries are submitted, they will go to JCDecaux's panel of judges (the "Judges") for review and to select the winning entries.
- The Judges' decision is final and no correspondence will be entered into regarding the outcome. Due to the number of entries received, we cannot guarantee feedback on individual entries.
- The Judges may, at their sole discretion, reallocate an entry to a different category or introduce a new category where they consider it more appropriate. We accept no responsibility for any costs or consequences arising from reallocation.
4. Deadlines and submission requirements
- All entries must be received by the stated deadline date published on the Portal. Late entries may be rejected and will not be considered by the Judges.
- It is your sole responsibility to ensure your entry is complete, compliant, and successfully submitted before the deadline. We are not responsible for entries that are incomplete, corrupted, misdirected, inaccessible, or not received due to technical, network, or user error.
5. Format and specifications
- Each entry must include, at a minimum, the name of the category entered, the entry title, and the names of the company or agencies to be credited for the work. You must also provide an executive summary which will be published and the dates during which the campaign ran.
- Supporting images of the work are mandatory, and you must provide logos for all teams and organisations to be credited.
- Each entry must be provided via the Portal as a written entry or as an optional video entry.
- Supporting video is encouraged but not required. Where provided, it should be supplied as an accessible link to Vimeo or YouTube. If any password is required for access, you must supply it and ensure that the link remains accessible to the Judges for the full duration of the judging period. You are responsible for ensuring all links function as intended.
6. Use of entrant details and communications
- The entrant contact details provided on the Portal will be used for the administration of the awards, including service communications about entries, judging, shortlists, event logistics, and results.
- We will add entrant contact details to our marketing database so that you may receive invitations to relevant events and occasional best practice information or news from JCDecaux. You can unsubscribe from these marketing communications at any time using the opt-out mechanism provided in our emails. Service communications relating to the awards will be sent irrespective of marketing preferences.
- We will share entrant details and entry content with our Judges and service providers as necessary for the administration and judging of the awards, and we will process personal data in accordance with applicable data protection laws and our privacy practices. Further details about our data processing, including retention periods and data subject rights, will be made available via our privacy information provided on or linked from the Portal.
7. Case studies: For winning entries, we may request permission to develop the entry into a public case study. We will not publish a case study based on a winning entry without the entrant's permission. We reserve the right to aggregate and anonymise entry data across submissions to conduct analysis and report on market trends, which we may publish or share in reports, presentations, or other materials.
8. Announcements and publicity: We will announce shortlisted entries and winners via press releases, online and on social media channels. By entering, you consent to us using your organisation's name and logos and details of your entry. The executive summary will be published.
9. Verification and audit: We reserve the right to request evidence and to verify the accuracy of information provided in an entry. Failure to provide satisfactory verification within the timeframe specified by us may result in disqualification.
10. Fees: We do not charge any fees for entries or for tickets to the awards event.
11. Disqualification and withdrawal:
- We may, at our discretion, refuse, disqualify, or remove any entry that does not in our reasonable opinion, comply with these Terms and Conditions, that we reasonably believe to be misleading, fraudulent, offensive, unlawful, or otherwise inappropriate, or that fails verification.
- We reserve the right to disqualify any entry that has a complaint upheld against it by a relevant and recognised regulatory industry body.
- If you wish to withdraw an entry, you must notify us in writing; we cannot guarantee withdrawal if judging or publication steps have commenced, but we will take reasonable steps to accommodate withdrawal of materials not already public.
12. Intellectual property rights and licences:
- Subject to the use and publication rights granted in these Terms and Conditions, all intellectual property rights in entry materials remain with their respective owners.
- You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, and communicate the entry materials as necessary for the administration and judging of the awards, for the publication of the executive summary and images as set out above, for publicity relating to the awards, and, where permission is given, for case studies.
- You warrant that you have the right to grant these licences and that our use will not infringe third-party rights.
13. Confidentiality: We will take reasonable steps to preserve the confidentiality of materials clearly marked "Not for Publication" and disclosed solely for judging and verification.
14. No guarantee and exclusion of liability:
- Participation in the awards does not guarantee shortlisting, an award, publicity, or any particular outcome or benefit.
- To the fullest extent permitted by law, we exclude all conditions, warranties, and representations, whether express or implied, including regarding the Portal's availability or error-free operation.
- We will not be liable for any loss of profit, revenue, business, goodwill, or indirect or consequential losses.
- To the maximum extent permitted by law, we shall have no liability to you (whether in contract, tort (including negligence), breach of statutory duty, or otherwise) arising out of or in connection with the awards, the Portal, or these Terms and Conditions.
- Nothing in these Terms and Conditions limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded or limited.
15. Changes, cancellation, and force majeure We may update these Terms and Conditions and the awards timetable, categories, or processes from time to time. Material changes will be reflected on the Portal. We may suspend, postpone, or cancel the awards where circumstances beyond our reasonable control make it necessary to do so, including but not limited to acts of God, strikes, failures of suppliers or platforms, or regulatory requirements. We will not be liable for any costs or losses arising from such changes or cancellation.
16. Governing law and jurisdiction These Terms and Conditions and any non-contractual obligations arising out of or in connection with them are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms and Conditions.
